RESUMO
No Brasil, o sequestro de rendas públicas, como procedimento punitivo com vistas à satisfação de um crédito obtido contra um ente público, tem previsão constitucional desde a redação original do art.100 da CF/88. Somente após a Emenda nº 62 este instituto foi fortalecido para compreender duas espécies: a) preterição de precedência; b) não alocação de recursos na lei orçamentária. Contudo, a Emenda nº 62 veda o sequestro quando o ente público esteja qualificado para o regime especial de precatórios, pelo qual pode pagar seus débitos mediante amortizações. Através do julgamento das ADI’s nº 4.357 e 4.425, pelo STF, a citada emenda foi considerada parcialmente inconstitucional, por ter se contraposto a numerosos princípios constitucionais. Em que pese o julgamento, o sequestro continua proibido, até que aquela Casa de Justiça module os efeitos desta inconstitucionalidade.

ABSTRACT
In Brazil, the seizure of public revenue, as a punitive procedure towards the satisfaction of a credit, obtained against a public entity, has constitutional preview, since the original article 100 of the Brazilian Federal Constitution. Only past the 62nd Amendment this institute was strengthened to comprise two cases: a) postponement of a priority creditor and, b) no inclusion of necessary revenue in the annual budget. However, the 62nd Amendment prevents the seizure when the public entity is qualified to the special regime of “precatórios”, by which it can pay its debts by a system of instalments. Through the judgement of the Actions of Unconstitutionality 4,357 and 4,425, by the Supreme Court of Brazil, this amendment was declared partially unconstitutional, for having contradicted many constitutional principles. Despite this judgement, the seizure remains forbidden as long as that House of Justice does not decide about the modulation of effects of the foretold unconstitutionality.
